1. WHO WE ARE

This website is operated by Raj Khan, a sole trader (ABN 45 706 384 104), trading as The Coldstart Collective. Throughout these terms, "we", "us" and "our" refer to The Coldstart Collective. "You" means the person using this site or placing an order.

2. AGREEING TO THESE TERMS

By visiting coldstartcollective.com.au or placing an order, you agree to these Terms of Service, along with our Shipping Policy, Refund Policy and Privacy Policy, which form part of this agreement. If you do not agree with any part of them, please do not use the site.
We may update these terms at any time. The version published on this page when you place an order is the version that applies to that order. Continuing to use the site after a change means you accept the updated terms.
3. WHO CAN ORDER

You must be at least 18 years old, or have the consent of a parent or guardian, and be legally able to enter a contract. We ship within Australia and internationally.
4. OUR PRODUCTS
---------------
We sell printed floor mats, supplied as a set of four (two front, two rear).
- One size, universal fit. Our mats are not moulded, cut or tailored to any particular vehicle. Dimensions are published on every product page. It is your responsibility to check them against your vehicle before ordering.
- Printed to order. Nothing is held in stock. Each set is produced after you order it.
- Production variation. These are dye-sublimation printed textiles, cut and finished by hand. Expect up to 1–2 cm of variation in size and print placement between sets. Variation within that range is normal and is not a fault.
- Colour. Screens render colour differently. We describe our products as accurately as we can, but we cannot guarantee that the colour you see on your device exactly matches the finished product.
Product images may include digitally created renders as well as photographs. Where a render is used, it depicts the design as it is printed.
5. ORDERS
---------
Your order is an offer to buy. No contract exists until we send you an order confirmation. We may decline or cancel an order — and will refund you in full if we do — where the product is unavailable, where there has been a pricing or description error, where we suspect fraud, or where we cannot verify the delivery address.
Please check your order carefully before paying. Because every set is made specifically for you, we can only change or cancel an order before production begins. Email us as soon as possible; once printing has started we cannot cancel.
6. PRICES AND PAYMENT

All prices are in Australian dollars. We are not currently registered for GST, so no GST is charged on your order and no tax invoice will be issued.
We may change prices at any time, but a change will never affect an order we have already confirmed. If a product is listed at an obviously incorrect price, we are not obliged to supply it at that price and will contact you before proceeding.
Payment is processed by Shopify and its payment providers. We do not receive or store your full card details. You warrant that you are authorised to use the payment method you provide.
7. DELIVERY

Within Australia, estimated delivery is 14 days from the day you order, covering production and transit together, and standard shipping is free on every order, with express available within Australia for $15 AUD. International shipping is a flat $20 AUD and delivery times vary by destination. Customs duties and import taxes charged by the destination country are your responsibility. These timeframes are estimates, not guarantees. Risk in the goods passes to you on delivery.

8. RETURNS AND YOUR RIGHTS UNDER AUSTRALIAN CONSUMER LAW

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they are not of acceptable quality and the failure does not amount to a major failure.
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law. Our Refund Policy sets out how to make a claim, and also describes the additional 30-day change-of-mind period we offer voluntarily — that period is on top of your legal rights, not instead of them.
9. INTELLECTUAL PROPERTY

All artwork, designs, photographs, text, logos and layout on this site are owned by or licensed to us and are protected by copyright and trade mark law. You may not reproduce, distribute, or create derivative works from our designs, or reproduce our artwork on any product, without our written permission.
You may not resell our products as your own, or use our images to advertise goods that are not ours.
10. YOUR USE OF THE SITE

You agree not to use the site for any unlawful purpose, to attempt to gain unauthorised access to it, to interfere with its operation, or to use automated systems to extract data from it without our permission.
11. CONTENT YOU SUBMIT
----------------------
If you send us reviews, photographs, comments or other material, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and display that material in connection with our business, including in marketing. You confirm the material is yours to give, is accurate, and does not infringe anyone else's rights. We are not obliged to publish anything you send, and may remove content at our discretion.
12. THIRD PARTIES

Our store runs on Shopify, our products are produced by a third-party printer, and delivery is handled by third-party carriers. We are not responsible for the acts or omissions of third parties beyond our reasonable control, though this does not limit your rights under the Australian Consumer Law.
This site may link to third-party websites. We do not control them and are not responsible for their content or practices.
13. LIABILITY

Nothing in this clause limits your rights under the Australian Consumer Law or any other law that cannot be excluded.
Subject to that, and to the extent permitted by law: we are not liable for indirect or consequential loss, loss of profit, or loss arising from your use of or inability to use the site; and where we are permitted to limit our liability, our total liability to you for any claim is limited to the amount you paid for the goods to which the claim relates.
Our mats sit on top of your vehicle's existing floor. You are responsible for fitting them safely and for ensuring they do not interfere with the pedals or your control of the vehicle. Do not stack them on top of existing mats.
14. INDEMNITY

You agree to indemnify us against any claim arising from your breach of these terms or your misuse of the site, except to the extent the claim results from our own negligence or breach.
15. PRIVACY
-----------
We handle personal information in accordance with our Privacy Policy and the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
16. SUSPENSION AND TERMINATION
------------------------------
We may suspend or withdraw the site, or refuse service to anyone, at any time and without notice. Clauses that by their nature should survive termination — including intellectual property, liability and governing law — will continue to apply.
17. GENERAL
-----------
If any part of these terms is found to be unenforceable, the rest continues to apply. Our failure to enforce a right is not a waiver of it. These terms are the entire agreement between us regarding the site and supersede any earlier understanding.
18. GOVERNING LAW
-----------------
These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of that state.
